This penny looks like the top layer is not there but the "in God" is minted on the next layer. Please advise.

Difficult to tell what is going on with this coin. It is well circulated so this could be done outside of mint, known as post mint damage. Coins are abused in many different ways, some used as tools some as spacers, some as crazy experiments. The issue appears minor, and there appears to be some sort of damage associated with it. My gut feeling is to call it post mint damage.
In my opinion it does not look like a strike through or lamination issue, but we will see what others say.
