If the mintmark is filled in is it considered a error of any kind? Severe die scratches and die gouge on his jacket on obverse. ONe has had a case of LDS?

In my opinion, even if a number or letter is completely filled in, it was pretty common over many decades. It would have to be pretty dramatic for some one to go for it. I typically toss ones that have at least one number or letter filled into the bargain bins.
